India ne Hague Tribunal ke Award ko illegal bataya, Indus Waters Treaty par apna stand dohraya
ARTICLE
Bharat ne Hague ki Court of Arbitration dwara Indus Waters Treaty ko lekar diye gaye latest award ko svikar karne se inkar kar diya hai. Ministry of External Affairs ne tribunal ko illegally constituted batate hue kaha hai ki uske faisle Bharat ke sovereign decisions par koi prabhav nahi daal sakte.
MEA ke mutabik Court of Arbitration ka gathan World Bank dwara 1960 ke Indus Waters Treaty ke provisions ka ullanghan karte hue kiya gaya tha. Bharat ne kaha ki usne is arbitration body ke legal existence ko kabhi recognise nahi kiya aur na hi uski proceedings mein bhaag liya.
India ne tribunal ki authority ko reject kiya
Bharat ka kehna hai ki Court of Arbitration ko Bharat ke sovereign decisions par faisla dene ka koi adhikar nahi hai. MEA ne kaha ki tribunal ke ab tak ke aur future pronouncements Bharat dwara kiye ja rahe projects par koi asar nahi daalenge.
India ka stand ye hai ki arbitration body ka formation hi Treaty ke framework ke viruddh tha. Isi wajah se Bharat tribunal ke proceedings aur uske awards ko legally valid nahi maanta.
Hague tribunal ne kya kaha?
Hague ki Court of Arbitration ne kaha ki Indus Waters Treaty ko suspend ya terminate karne ke liye diye gaye grounds Treaty ki obligations ko rokne ke liye paryapt nahi hain. Tribunal ke mutabik Treaty ke provisions ke tahat India ko apni obligations continue karni chahiye.
Tribunal ne Jammu and Kashmir mein Ratle Hydroelectric Power Project se judi kuch interim measures bhi order kiye. Ismein dam wall aur power intake structure ke kuch hisson par specified levels se upar concreting ko temporary restrict karna shamil hai.
Tribunal ne Ratle project ki construction schedule se judi reporting requirement bhi rakhi hai. Ye measures Neutral Expert ke final decision ke baad specified period tak lagu rehne hain.
Indus Waters Treaty par India ka stand
Latest ruling ke baad bhi Bharat ne apna purana stand nahi badla hai. MEA ne spasht kiya ki Indus Waters Treaty ko abeyance mein rakhne ka Bharat ka decision ab bhi force mein hai.
Indus Waters Treaty 1960 mein Bharat aur Pakistan ke beech World Bank ki sahayata se hui thi. Treaty Indus river system ki rivers ke water-sharing arrangements ko regulate karti hai.
Is dispute ka ek important hissa Jammu and Kashmir ke Kishenganga aur Ratle hydroelectric projects se bhi juda hua hai. Bharat aur Pakistan dono is Treaty ki interpretation aur dispute-resolution mechanism ko lekar alag positions rakhte aaye hain.
Aage kya ho sakta hai?
Is latest development ke baad Indus Waters Treaty ko lekar Bharat aur Pakistan ke beech legal aur diplomatic disagreement aur gehra ho sakta hai.
Ek taraf Hague tribunal ne Treaty ki continuing validity par apna view diya hai, jabki Bharat tribunal ki jurisdiction ko hi accept nahi karta. Isliye ground par tribunal ke directions aur Bharat ke sovereign decisions ke beech disagreement bana reh sakta hai.
